Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "your", or the "User") and Mastos Odyssey Limited (trading as "CandleScan", "we", "us", or "our"), the provider of the CandleScan mobile application and any related content, features, and services (together, the "Service").

By downloading, accessing, creating an account for, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

1. IMPORTANT — Educational Tool Only; Not Financial Advice

Please read this section carefully.

CandleScan is an educational and informational utility tool. It is not a financial adviser, broker, dealer, or investment service, and it does not provide financial, investment, trading, tax, accounting, or legal advice of any kind.

Everything the Service produces — including AI-generated chart analysis, trend reads, support/resistance levels, patterns, "setup scores", "confidence" values, risk/reward figures, trade plans, targets, stop levels, Fibonacci levels, and any other output — is provided for general educational and informational purposes only and:

  • is not a recommendation, solicitation, endorsement, or offer to buy, sell, hold, or enter into any transaction in any security, cryptocurrency, currency, commodity, derivative, or other financial instrument;
  • is not a forecast, prediction, signal, or guarantee of any future price movement, outcome, profit, or performance;
  • must not be relied upon as the basis for any trading or investment decision.

Any "confidence", "setup score", or similar value is a subjective, illustrative indication of how clearly the AI could read an image — it is not a probability of profit, a win rate, or a statistical measure of success. Any numbers shown as prices, levels, or targets are estimates read from a static image and may be highly inaccurate.

You are solely and exclusively responsible for your own trading and investment decisions and their consequences. You should carry out your own research and, where appropriate, seek advice from an independent, qualified, and licensed financial professional before making any financial decision. Trading and investing involve a substantial risk of loss and are not suitable for everyone; you can lose some or all of your capital.

2. Eligibility

To use the Service you must be at least 18 years old (or the age of legal majority in your jurisdiction, if higher), and you must have the legal capacity to enter into these Terms. You must not use the Service if you are barred from doing so under any applicable law. By using the Service you represent and warrant that you meet these requirements.

3. What the Service Does — and Does Not — Do

CandleScan lets you capture or import a static image (screenshot) of a trading chart and receive an AI-generated technical interpretation, alongside supporting tools such as AI chat, a trade journal, performance statistics, and risk calculators.

You acknowledge and agree that:

  • No live or real-time market data. The Service analyses a single static image. It does not access live prices, order books, order flow, fundamentals, news, or any real-time market data.
  • AI interpretation only. Analysis is generated by third-party artificial-intelligence models and is an interpretation, not a fact. It may be incomplete, inaccurate, out of date, or wrong.
  • Your own data. Journal statistics, "Insights", and accuracy tracking are calculated solely from information you enter. They reflect your own inputs, not verified market outcomes.
  • Not a Backup Service. While we store your journal entries and history to provide the Service, CandleScan is not a secure data backup service. We are not liable for the loss or corruption of your data. You are solely responsible for exporting and backing up your own records.
  • Availability may change. Features may be added, changed, suspended, or removed at any time without notice.

4. AI-Generated Content

The Service uses third-party large-language-model and computer-vision AI providers to generate analysis. AI systems can produce output that is plausible-sounding but incorrect, incomplete, biased, or fabricated ("hallucinated"). We do not independently verify AI output and make no representation that it is accurate or reliable. You must independently verify any information before acting on it.

5. Assumption of Risk

You understand and expressly agree that:

  • trading and investing in financial instruments is highly speculative and carries a high level of risk;
  • past performance is not indicative of future results;
  • you may lose some or all of the capital you commit; and
  • you use the Service and act on any output entirely at your own risk.

6. Accounts

To use the Service you must create an account. You agree to provide accurate information and to keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Accounts are for individual use; you may not share, sell, or transfer your account. We may refuse, suspend, or terminate accounts at our sole discretion.

7. Subscriptions, Billing, and Statutory Rights

Access to the Service requires a paid subscription, subject to the following terms:

  • App Store Billing. Purchases are made through the Apple App Store and are subject to Apple's terms.
  • Auto-Renewal. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period.
  • Statutory Right of Withdrawal (UK/EU Users). By purchasing a subscription, you expressly request and consent to immediate access to the digital content provided by the Service. You acknowledge and agree that by accessing the Service immediately, you lose your statutory 14-day right to cancel the contract and claim a refund.
  • Refunds. All payments are processed by the Apple App Store. Except where strictly required by applicable law, subscription fees are non-refundable, and refunds must be requested directly from Apple under its policies.

8. Your Content and AI Training

You retain ownership of the content you provide, including chart images, journal entries, and notes ("User Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display your User Content solely to operate and provide the Service to you.

AI Model Training Guarantee:

We do not use your User Content to train our own AI models. Furthermore, we transmit your chart images to third-party AI providers strictly via secure APIs. Our agreements with these providers stipulate that your data is not used to train their models, though it may be temporarily retained by them for standard security and abuse-monitoring purposes.

You represent and warrant that you own or have the necessary rights to your User Content. You are solely responsible for your User Content.

9. Acceptable Use

You agree not to:

  • upload, capture, or import watermarked, paywalled, or proprietary trading charts or data that you do not have the explicit legal right to reproduce and process;
  • present the Service's output to others as financial advice, a signal service, or a guarantee of results;
  • reverse engineer, decompile, or attempt to extract source code or underlying models;
  • interfere with or circumvent the security, rate limits, or intended operation of the Service;
  • resell, sublicense, or commercially exploit the Service without our written permission; or
  • use the Service to build a competing product.

10. Intellectual Property

The Service, including the CandleScan name, logo, software, design, and text (excluding your User Content), is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use.

11. Third-Party Services

The Service relies on third parties, including Apple (distribution and payments), OpenAI (AI analysis), Supabase (database), and RevenueCat (subscription management). Your use may be subject to those parties' terms, and your data is processed by them as described in our Privacy Policy. We are not responsible for third-party services and do not control their uptime or reliability.

12. Disclaimers; "As Is"

To the fullest extent permitted by law, the Service and all output are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any output will be accurate. Temporary outages of third-party APIs (such as AI generation downtime) do not constitute a breach of these terms and do not entitle you to a refund.

13. Limitation of Liability

To the fullest extent permitted by law:

  • we will not be liable for any trading or investment losses, lost profits, loss of data, or for any indirect, incidental, special, or consequential damages arising out of your use of the Service; and
  • our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) £50 (or local-currency equivalent).

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence or for fraud.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including legal fees) arising out of your misuse of the Service, your breach of these Terms, your User Content, or your violation of any third-party intellectual property right.

15. Suspension and Termination

You may stop using the Service at any time and delete your account from within the app. We may suspend or terminate your access without notice if you breach these Terms. Sections that by their nature should survive (including Sections 1, 5, 8, 10, 12, 13, 14, and 17) will survive termination.

16. Changes to the Service and Terms

We may modify these Terms at any time. We will notify you of material changes (e.g., via in-app notice or updating the "Last updated" date). Continued use of the Service after changes take effect constitutes acceptance.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles. The courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer, you may also benefit from mandatory protections and forum rights of your country of residence.

18. App Store Additional Terms

These Terms are between you and us, not with Apple Inc. To the extent required by Apple's platform terms:

  • Apple is not responsible for the Service, its content, or maintenance and support.
  • We, not Apple, are responsible for addressing any claims relating to the app, including product-liability or intellectual-property claims.
  • Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.

19. General

These Terms and our Privacy Policy represent the entire agreement between us. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver.
